World Putting Tour Terms & Conditions
By accepting this agreement, I acknowledge that: I will become a member of the World Putting Tour, a Division of Putting World Global. I agree to comply with and be bound by The World Putting Tour’s Rules and Regulations incorporated herein and integrated herewith by this reference. The World Putting Tour’s Rules and Regulations may be amended at any time.
Membership Rights
Membership in the World Putting Tour grants access to participating in World Putting Tour events. An active WPT membership is required for eligibility in WPT events. The World Putting Tour shall have full power and authority to establish, maintain and modify membership classifications, determine the overall number of members, fees and charges of each classification. By use of a Putting World venue, each member agrees to be bound by all terms and conditions of this Agreement. In the event of a breach by such members of this Agreement or of any of the rules and regulations of the Club, member agrees to satisfy the amount of The World Putting Tour’s claim against such member. Each member voluntarily assumes all risks associated with use of the Putting World venues. The right of the Putting World member listed above may be suspended or revoked by The World Putting Tour upon violation of this Agreement or the rules and regulations of The World Putting Tour.
Payments
Initiation fees are non-refundable. Member account will be subject to a $25 fee for any EFT/CC charge returned unpaid or for nonsufficient funds. Member agrees to pay all reasonable attorneys’ fees and other fees and costs incurred by the World Putting Tour in the event the account is turned over for collections.
Membership
Membership in the World Putting Tour is a 12-month term based on the anniversary date of joining the World Putting Tour and paying the annual initiation fee.
Transfer & Reassignment of Membership
Membership may not be transferred.
Assumption of Risk
Member understands that use of PW venues will be undertaken at your sole risk. You agree that you are voluntarily participating in activities and using the venues and premises and you assume all risk of injury, illness, damage or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property.
Member agrees that Putting World Global and the World Putting Tour, its affiliates, subsidiaries, officers, directors, employees, and agents will not be liable for any claims, demands, injuries, damages, actions or causes of action whatsoever in respect of Member or Member property (including lost or damaged personal possessions) (collectively, “Claims”), arising out of or connected with the use of any of the services of The World Putting Tour. Member expressly releases and discharges World Putting Tour Parties from all such Claims except to the extent any Claims result directly from any gross negligence, reckless conduct or intentional misconduct on the part of one or more World Putting Tour representatives.
Rules and Regulations
All Members are subject to compliance with any rules and regulations World Putting Tour that may be posted from time to time at the venue and/or online. Member also acknowledges and agrees to fully comply with all applicable alcoholic beverage controls laws including, but not limited to, the prohibition of consumption of alcoholic beverages by a person(s) who are underage and/or cannot produce proper identification. In the event that a Member fails to comply with said rules and regulations, World Putting Tour may (1) suspend all Membership privileges or (2) void this Agreement and revoke all Membership privileges. World Putting Tour reserves the right to amend or alter these rules and regulations at any time in our sole discretion. All amendments to these rules and regulations shall be effective immediately.
The World Putting Tour has the right to establish rules and regulations governing the World Putting Tour events.
Dress Code/Personal Conduct
Appropriate clothing and footwear are always required based on venue rules and regulations. Bare feet are not acceptable anywhere at World Putting Tour events. Footwear that may damage or change the integrity of the putting surface is not allowed on putting surfaces. The World Putting Tour reserves the right to determine proper clothing and footwear.
Inappropriate, foul and/or lewd language or behavior is not acceptable and will result in suspension of your Membership and you will not be entitled to a refund of any membership fees or dues or other fees that have been paid.
Injuries
Member will immediately report any accident or injury suffered during a World Putting Tour event to a staff person and will provide a written report from your doctor within a reasonable time.
Damage to World Putting Tour Venues and Equipment
You agree to pay for damage to World Putting Tour equipment and premises and third-party property caused by your careless use of equipment or other intentional or negligent acts.
Reselling of Membership
Memberships may not be used for resale, advertising, or other promotion without prior approval by the World Putting Tour Director or assigned Representative.
Use of World Putting Tour Name/Logo/Images
All promotional and display materials, including any images or materials (collectively, “Images”), that refer to or depict the World Putting Tour’s name, logo, symbol, trademark or tradename (“World Putting Tour Marks”) shall be subject to World Putting Tour’s prior written approval. You may not use or display any names, symbols, logos, trade names or trademarks owned by (or identified with) any third party, without the prior written approval of the World Putting Tour. You have no rights or interest in any intellectual property owned or licensed by the World Putting Tour. Images may not be used to state or imply the endorsement by the World Putting Tour or of any World Putting Tour personnel with any commercial product, process or service, or used in any other manner that might mislead or imply any approval, sponsorship, endorsement or affiliation between you and the World Putting Tour. Commercials or other promotional messages may not be filmed at World Putting Tour events unless you enter into an agreement with the World Putting Tour expressly permitting such use. You may not use trademarks, logos or other content that is confusingly similar to the World Putting Tour Marks. If you wish to obtain the World Putting Tour’s permission for any use of images or the World Putting Tour Marks or for any other use which is not specifically addressed in this Agreement or you become aware of unauthorized use of the the World Putting Tour Marks, please contact tsuzor@puttingworld.com. Please note that permission is at World Putting Tour’s sole discretion and, if granted, will only be granted under certain conditions and/or subject to you entering into a separate agreement or license with World Putting Tour.
Testimonials
Members understand and agree that images and likenesses of members in photographs, videotapes, motion pictures, recordings and other media may be used in connection with publicizing and promoting the World Putting Tour and agree to provide an unlimited, perpetual royalty free license to use such input and images in its publications, sales collateral, websites, and/or in any other printed or electronic publications at any time without any conditions or restrictions. Members agree that members will make no monetary or other claim against the World Putting Tour for the use of statement, input or image. In addition, members waive any right to inspect or approve the finished product, including written copy, herein their likeness or testimonial appears. Members shall indemnify hold harmless and release World Putting Tour from all claims, demands and causes of action, including without limitation invasion of privacy, misappropriation of image, publicity and infringement upon intellectual property rights which any member, guests, immediate family members, member’s heirs, representatives, executors, administrators or any other persons acting on any member’s behalf or on behalf of any member’s estate have or may have by reason of this authorization.
Amendments
World Putting Tour may amend the Rules and Regulations at any time without notice to members and guests.
Miscellaneous
- No Equity or Ownership Interest. I understand and agree that my membership in World Putting Tour is not an investment in World Putting Tour, and I am not obtaining an equity or ownership interest in World Putting Tour. My membership does not confer upon me a vested or prescriptive right or easement to use World Putting Tour property.
- Non-waiver: No waiver of any provision in this Agreement shall constitute a waiver of any other provision nor shall any waiver constitute a continuing waiver.
- Assignment: World Putting Tour may assign this Agreement, and, provided that the assignee agrees to assume the obligations of World Putting Tour in this Agreement, then World Putting Tour will be fully relieved of those obligations upon notice to you of the assignment. You understand that you may not assign your membership to another person.
- Governing Law: This Agreement is governed by the laws of the State of Arizona, and the parties hereto agree to the venue of the District Court of Maricopa County.
- Invalid Provisions: If any part of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
- Entire Agreement and Definition: This document incorporates the entire Agreement between Members and World Putting Tour. World Putting Tour reserves the right to modify this Agreement from time to time. There are no representations, warranties, terms, conditions, undertakings or collateral agreements express, implied or statutory, between the parties hereto except as specified in this Agreement. Member waives any rule of construction or interpretation that construes any vague or ambiguous provisions against the drafter.
By accepting this agreement, I acknowledge that:
I have read, understand, and agree to all of the information under the terms, conditions and policies of this membership agreement.
In addition, I understand and agree that the assumption of risk, waiver and release of all claims provisions set forth in the terms and conditions of this agreement are in effect throughout my membership with world putting tour. I also understand and agree that if my membership is interrupted for any reason, this agreement will remain in effect during the period of interruption as well as after the membership is reinstated. This agreement is the entire agreement, and no verbal or other agreements have been made to alter the terms of this agreement.
Rules & Regulations
By using and participating in any World Putting Tour events, you agree to abide by the following safety rules, as well as other safety rules posted at the venue and/or online:
- Obey all verbal and posted rules and instructions.
Use common sense to protect yourself and others. - Members are responsible for damages or injuries caused by their actions.
- Throwing any item, including without limitation to golf balls and golf clubs is prohibited. Likewise, guests need to mind where and how they are swinging their golf clubs.
- Minors must be accompanied by a parent or guardian at all times.
- Running is not allowed at World Putting Tour events.
- Inappropriate, foul and/or lewd language or behavior is not acceptable and will result in suspension of your
- Membership and access to World Putting Tour events.
Members are subject to the control and guidance of World Putting Tour staff and must follow their instructions while participating in World Putting Tour events. Members agree to conduct themselves in a well-mannered fashion when in or about World Putting Tour events. Any member who by his/her conduct and/or demeanor interferes with the enjoyment of World Putting Tour events by other members and guests and/or the orderly maintenance, safety and operation of World Putting Tour events shall be subject to membership revocation. World Putting Tour has the right to revoke any membership with just cause. - Each Member knowing and voluntarily assumes all risks associated with use of World Putting Tour event venues.
